Understanding Divorce Home Appraisals and Spouse Buyouts

What does a divorce home appraisal value?

A divorce appraisal develops an independent opinion of value for identified residential real estate or a specifically scoped interest as of an agreed effective date. It can support property-settlement discussions or a spouse buyout. It does not appraise every marital asset, value a business or determine how ownership should be divided.

Is a home appraisal required in every divorce?

The need depends on the dispute, agreement and case requirements. Ask counsel whether a new valuation, a historical valuation or a review of an existing appraisal is appropriate. An appraisal should answer a defined value question; ordering one does not guarantee that both parties will accept its conclusions.

How does home value differ from equity?

Appraised value is a value opinion for the specified real estate interest and date. Equity and a proposed buyout payment also depend on financing balances, ownership terms and other items the parties or their advisers determine. Appreciation alone does not tell the appraiser who is entitled to a particular share. Those decisions belong in the legal and settlement process.

Which date and users should the report address?

Confirm the effective date, intended use, client, intended users and reporting requirements before engagement. Current value and retrospective value answer different questions. For a historical assignment, provide dated photographs, earlier listings, permits and records of repairs or additions. Identify changes after the requested date and discuss missing historical evidence.

What happens during the assignment?

The agreed scope determines the inspection, records and analysis needed. Prepare access arrangements and property information, including significant condition issues, additions, accessory units, condominium rights or multiple parcels. The appraiser analyzes relevant market evidence and explains the conclusions in the report. Discuss delivery and authorized report use at engagement rather than assume automatic distribution to everyone involved.

If you already have conflicting reports, identify the disputed date, property facts, methods or conclusions. A separately scoped residential appraisal review evaluates another report; it is not automatically a new appraisal of the home.

What should you send for a quote?
